Otter Beam

Terms of Service

These Terms govern your use of Otter Beam, including the Otter Beam application, Otter relay, and related services. By using Otter Beam, creating an account, or subscribing to a paid plan, you agree to these Terms.

1. Eligibility

You must be at least 13 years old and old enough to enter into a binding agreement in your country or territory. If you use Otter Beam on behalf of an organization, you represent that you have authority to bind that organization to these Terms. You are responsible for complying with laws and third-party terms that apply to your use.

2. What Otter Beam Is

Otter Beam is a terminal workbench that connects your device over SSH and tmux to machines that you own, control, or are authorized to access. It helps you view and operate terminal sessions, including sessions in which AI coding agents such as Claude Code or Codex CLI may be running.

Otter Beam is not an AI provider. AI coding agents run on your own machine under your own accounts, API keys, credentials, subscriptions, configurations, and provider terms. Otter Beam does not run those agents for you and does not independently execute or approve their output.

3. Accounts and Security

Some features require an Otter Beam account. You must provide accurate information, keep your account and authentication methods secure, and promptly notify us if you suspect unauthorized access. You are responsible for activity performed through your account and for securing every machine, SSH server, key, credential, tmux session, network, and third-party account you connect to Otter Beam.

You may not share access in a way that evades plan limits, misrepresents the account holder, or gives an unauthorized person access to a machine or service.

4. Your Machines, Commands, and AI Agents

You are solely responsible for the machines you connect, the terminal sessions you open, the commands you or your agents run, and the effects of those commands. This includes changes to source code, files, credentials, infrastructure, accounts, data, and external systems.

AI agents and their output can be incorrect, unsafe, incomplete, destructive, or unsuitable for your purpose. You must configure, supervise, and review them appropriately, maintain suitable backups and access controls, and obtain any permissions required before acting on systems or data. Otter Beam does not execute AI output on your behalf and is not responsible for agent behavior on your machine.

Normal interactive use of Otter relay for AI coding agents, terminals, files, and displays is allowed.

6. Direct Connections and Otter Relay

LAN, Tailscale, and other direct SSH connections that you provide and control do not pass through our servers and are not metered or billed by us. Your network provider and Tailscale may apply their own terms, limits, or charges.

Otter relay is an optional hosted forwarding service used when a direct connection is not reachable. It forwards end-to-end encrypted SSH traffic between your devices. We do not read commands, terminal output, files, or other SSH content carried through the relay. To operate, secure, and enforce fair use of the service, we use operational metadata such as connection duration, byte counts, and device counts.

Otter relay sessions are time-limited. When a session ends, you may manually reconnect right away. Current paid-plan limits allow up to four hours per relay session on Pro and up to seven days per relay session on Premium, subject to fair use and the plan details shown before purchase.

7. Fair Use

Otter relay is designed for normal interactive Agent, terminal, file, and display use. It is not a general-purpose bandwidth, storage, distribution, proxy, or VPN service.

To protect the service and other users, suspected misuse may result first in a warning. Continued or material misuse may be throttled. Serious or repeated violations may result in suspension. We will restore access after the issue is resolved and the account can return to compliant use.

8. Paid Plans and Cancellation

Paid plans are billed through Apple, Google, or Stripe, depending on the platform and purchase flow. Prices, billing intervals, taxes, included features, and usage terms are shown before purchase. You authorize the applicable payment provider to charge your selected payment method for recurring subscription fees and taxes until you cancel.

A paid entitlement belongs to the Otter Beam account identified by the same verified email and may be used on that account's supported devices. Only one active billing provider may fund an account at a time. To move between Apple, Google, or Stripe billing, cancel the existing subscription first; the new provider can be selected after the existing paid period ends. Do not purchase again under a different Otter Beam email if you intend to keep the same account data.

Paid plans may include AI-assisted features, such as voice transcription, subject to stated usage limits. Availability, providers, models, limits, and feature details may change over time. Unused allowances do not have cash value and do not roll over unless the purchase page expressly says otherwise.

You may cancel or manage a subscription through the provider that sold it: Apple App Store subscription settings, Google Play subscription settings, or the Stripe billing controls linked from Otter Beam. Cancellation stops automatic renewal and ordinarily takes effect at the end of the current billing period. Before account deletion, Otter Beam automatically stops renewal for active Stripe subscriptions and aborts deletion if it cannot do so. Deleting your account does not cancel an Apple or Google subscription, which continues until separately managed in the applicable store.

9. Refunds

Except where required by law or expressly offered by us, payments are non-refundable and we do not provide credits or refunds for partial billing periods, unused time, unused relay capacity, or unused feature allowances. In the event of a material service incident, we may proactively offer a partial refund based on unused time. If we issue a refund or credit, doing so does not require us to issue the same remedy in the future.

Apple and Google control refunds for purchases they process; request those refunds through the applicable store. Stripe purchase refunds are handled by us and Stripe under the displayed billing controls and applicable law. Refund timing and method may depend on the payment provider, payment method, disputes, fraud checks, taxes, and applicable law.

10. Third-Party Services

Otter Beam interoperates with or depends on third-party products and services, which may include operating systems, devices, networks, SSH, tmux, Tailscale, Cloudflare, Supabase, Apple, Google, Stripe, AI coding agents, and Alibaba Cloud (QwenCloud, formerly Model Studio) voice transcription. Your use of those services is governed by their own terms and privacy practices.

Supabase, Cloudflare, and Alibaba Cloud (QwenCloud, formerly Model Studio) provide infrastructure or processing services used to operate Otter Beam and act on our instructions for that purpose. Apple, Google, and Stripe separately control store or payment processing under their own transaction terms. Alibaba Cloud receives audio only when you deliberately use voice transcription.

Third-party services may change, fail, suspend access, impose limits or charges, or stop supporting features. We do not control and are not responsible for third-party services, AI output, or events on machines and accounts outside our systems.

11. Ownership and License

You retain your rights in your machines, terminal content, source code, files, data, and other materials. You grant us only the limited rights needed to process account and connection metadata and encrypted relay traffic to provide, secure, maintain, support, and bill for Otter Beam, and to comply with law.

Otter Beam, Otter relay, and their software, design, branding, documentation, and service materials belong to Otter Digital Pte. Ltd. or its licensors. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to use the service for its intended purpose.

12. Service Changes and Termination

We may add, change, limit, suspend, or discontinue features or services, including hosted features, when reasonably necessary for security, reliability, legal compliance, third-party changes, product development, or business operations. We may suspend or terminate access if you violate these Terms, fail to pay, create risk or harm, abuse the service, or if required by law.

You may stop using Otter Beam or hard-delete your account at any time. Ordinary self-service deletion does not place the email in a post-deletion ban list. Account deletion removes deletable cloud account data but preserves limited pseudonymous subscription and refund evidence for six years and a pseudonymous deletion receipt for two years. A documented legal hold or unresolved payment dispute may extend the applicable period. Pseudonymous records remain protected personal data and are not anonymous. Terms that by their nature should survive termination, including payment obligations, ownership, disclaimers, liability limits, indemnity, and governing law, will continue to apply.

13. Disclaimers

Otter Beam and Otter relay are provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, security, compatibility, and error-free operation.

We do not guarantee uninterrupted connections, preserved terminal sessions, successful commands, data recovery, AI or transcription accuracy, or that the service will prevent unauthorized access, data loss, machine failure, provider outages, or harmful agent behavior. You are responsible for backups, recovery plans, and safe operating practices.

14. Limitation of Liability

To the maximum extent permitted by law, Otter Digital Pte. Ltd. and its affiliates, officers, employees, contractors, suppliers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, data, code, credentials, business opportunities, or service availability, arising from or relating to Otter Beam.

To the maximum extent permitted by law, our total liability for all claims arising from or relating to Otter Beam is limited to the greater of the amount you paid us for Otter Beam during the three months before the event giving rise to the claim or USD 100. These limits apply regardless of the legal theory and even if a remedy fails of its essential purpose, but do not limit liability that cannot lawfully be limited.

15. Indemnity

To the extent permitted by law, you will indemnify and hold harmless Otter Digital Pte. Ltd. and its affiliates, officers, employees, contractors, suppliers, and licensors from claims, losses, liabilities, damages, costs, and expenses, including reasonable legal fees, arising from your machines, commands, agents, content, data, misuse of Otter Beam, violation of these Terms, or violation of law or third-party rights.

16. Governing Law, Changes, and Contact

These Terms are governed by the laws of Singapore, without regard to conflict-of-law rules. The courts of Singapore will have exclusive jurisdiction over disputes relating to these Terms or Otter Beam, except where applicable law requires otherwise.

We may update these Terms from time to time. If a change is material, we will provide notice in a reasonable way. The updated Terms take effect on the stated effective date, and your continued use after that date means you accept them.
